BWW’s experts on deregulation

In the text of ‘Dziennik Gazeta Prawna’, Aneta Gęsiarz-Krasucka, advocate, commented on the draft changes to the law on proceedings before administrative courts. In an interview with ‘Rzeczpospolita’, on the other hand, changes in the energy sector were assessed by attorney Michał Legodziński.

Ms Gęsiarz-Krasucka is an experienced, respected expert who specializes in public and administrative law. With a particular focus on issues concerning local government units, public finances, energy law and civil law.

In her commentary for the ‘DGP’, she notes at the outset that the proposed changes to proceedings before administrative courts mean less ‘paperwork’. And this is certainly to be commended.

At the same time, he points out that for years, however, the biggest problem has been the waiting time for the case to be heard by the Supreme Administrative Court (NSA), as it takes so long that sometimes the case ceases to make sense.

In an elaboration of this opinion on his Linkedin profile, he concludes:  – ‘This is more a tidying up of paperwork than a real reform (…) We need a real reform – not another “facelift” of a system that is already barely breathing. Without courage and a holistic approach, nothing will change.

Attorney Michał Legodzinski serves as Senior Managing Associate Energy Team at BWW law firm. He was asked by ‘Rzeczpospolita’ about the package of statutory deregulatory changes in the field of energy. He stressed that the creation of a transparent electricity price comparison engine and the obligatory inclusion of a QR code on the invoice, which links to it, were certainly good ideas. The direction of simplifying the energy invoice and the educational element of what it consists of is also absolutely right.

At the same time, the BWW law firm’s expert on whether this must involve a change in legislation or whether it is simply a matter of good practice for energy retailers.
