BWW is successfully advising on a growing number of infrastructure projects in the waste management sector
Our lawyers are experienced experts in, among other things, legal issues related to the entire investment process, including environmental issues and administrative challenges related to the construction of thermal waste conversion plants, biogas plants and other RES installations.
We are involved in all investments aimed at climate protection, particularly in renewable energy and the ‘greening’ of district heating systems in line with the targets set by the ‘Fit for 55’ package.
An example of such involvement is the work of BWW’s team in obtaining the environmental decision for the law firm’s client for the ITPO (Thermal Waste Processing Plant). The result of the cooperation is the successful conclusion of the administrative process. Recently, in a case handled by the Law Firm’s team, the second instance authority issued a decision upholding the contested environmental decision.
At the beginning of December this year, BWW lawyers recorded another success, providing legal assistance to an investor who sought to obtain a decision on environmental conditions. The process of obtaining the decision was conducted very effectively and quickly and the decision, despite an appeal, was upheld by the administrative court.
Transformation and local government
Local governments and their operational and business partners are a special participant in the transformation. Above all, because of their organisational specificity. Therefore, a professional and comprehensive approach to waste management is fundamental for them.
– From the investors’ point of view, these are key stages. A final environmental decision, as in the case of our client, means that it can be used in the further administrative process for the realisation of the investment, e.g. for a building permit. This often involves a legal dialogue with environmental organisations, as was the case in our proceedings. ITPO and biogas plants
This is the main reason why BWW engages in training organised by NFOŚiGW for its employees and partner entities, as well as for potential beneficiaries of various programmes. For example, Ms Małgorzata Banasik and Ms Weronika Wyszczelska shared their knowledge on investing in biogas plants at the end of November in Olsztyn. The topic of the presentation was primarily the administrative process, i.e. obtaining approvals and permits.
Another step in the educational and informational activities was the participation of mec. Michał Legodziński and mec. Weronika Wyszczelska from the infrastructure team of BWW Law Firm in the training course ‘Alternative fuels – ITPO’ in Gdynia, during which they gave an expert presentation ‘Waste heat, ETS – challenges facing thermal waste conversion.
